I discuss the knowledge account of legal proof in Moss (2023) and develop an alternative. The unifying thread throughout this article are reflections on the beyond reasonable doubt (BRD) standard of proof. In Section 1, I will introduce the details of Moss’s account and how she motivates it via the BRD standard. In Section 2, I will argue that there are important disanalogies between BRD and knowledge that undermine Moss’s argument. There is however another motivation for the knowledge account: combined (...) with auxiliary claims, that is probabilistic knowledge and moral encroachment, it can provide a general solution to the puzzle of statistical evidence. Section 3 spells out the details. In Section 4, I suggest to combine the knowledge account with pragmatic encroachment, instead of moral encroachment, in order to stay clear of the thorny issues whether corporations have moral rights. In Section 5, I argue that the verdicts of Moss’s account in cases of false justified beliefs and non-luminous knowledge conflict with the BRD standard and thus call for abandoning the account. Based on the social function of the BRD standard, I suggest a replacement for the knowledge account that is also just as potent as a general solution for the puzzle of statistical evidence. While I will grant that knowledge is neither always necessary nor always sufficient for convictions, I will argue that the concept of knowledge nonetheless plays a significant and ineliminable role in legal decision-making. Kathleen Higgins argues that the arguments that Plato used to defend the ethical value of music are still applicable today. Music encourages ethically valuable attitudes and behavior, provides practice in skills that are valuable in ethical life, and symbolizes ethical ideals.

Awe and wonder are theorised to be distinct from other positive emotions, such as happiness. Yet little empirical or theoretical work has focused on these emotions. This investigation explored differences in language used to describe experiences of awe and wonder. Such analyses can provide insight into how people conceptualise these emotional experiences, and whether they conceptualise these emotions to be distinct from other positive emotions, and each other. Participants wrote narratives about experiences of awe, wonder and happiness. There were differences (...) in the language used to describe these positive emotional states, consistent with the theorised functions of each emotion. Awe was related to observing the world, reflected in greater use of perception words. Wonder was related to trying to understand the world, reflected in greater use of cognitive complexity and tentative words. Language use for both emotions reflected an environmental focus, whereas language use for happiness reflected a social/relationship focus. (shrink)

This chapter defends a theory of objectification, conceiving of it as a species of what aestheticians have called ‘seeing‐as’, and more specifically, a kind of seeing‐as which to some degree is insensitive to the mind or mental aspects. An advantage of this view is that it covers both sexual and racial objectification, and can also explain how photographic images can objectify their subjects: namely, by encouraging the viewer to view in a way insensitive to the mind or mental aspects of (...) the subject. P.After some 30 years of incisive intervention in Platonic scholarship, Holger Thesleff here offers us "an attempt to elaborate and ground more firmly some basic theses which I have propounded in various contexts before," (1) a rather modest description of what he also describes as an (...) attempt to contribute toward "a more general agreement on how to read and interpret Plato" (5). The richness of this book makes it impossible to describe in any detail, and I shall content myself with indicating some of what I take to be its principal points of view.Thesleff"s concern for agreement arises from his perception of the vastly discrepant schools of Plato interpretation, of which the most important for him might be labeled esotericist, analytic, and "literary." The last, which can hardly be called a school at all, includes a variety of scholars who downplay "literal" interpretation and emphasize such things as "dramatic artistry, the structure of the dialogues, the characterization of settings and persons, shifts of style, allusions, play, and irony" (3). Thesleff's sympathies clearly lie with these people, perhaps to an extent which, as I shall suggest, will limit the effectiveness of his attempt to move toward a consensus.As the title indicates Thesleff builds his reading around what he calls Plato's two-level model. This two-level model is not, as one might suppose, what has been called Plato's two worlds view, the belief in a world of pure being beyond the perceived world we inhabit. Indeed, it is not a doctrine or set of doctrines at all. Rather "it is an intuitive 'vision' which offers only crude basic patterns and frames for the structures of Plato's thinking, feelings, intuitions, and intentions, from his youth to his old age, and for our understanding of them" (123). Clearly one cannot expect a full and precise articulation of this vision. Thesleff proceeds by discussing in terms of their role in the earlier dialogues ten hierarchic pairs which form part of Plato's vision: divine/human, soul/body, leading/being led (particularly important in the conduct of a Socratic discussion), truth/appearance, knowledge/opinion, intellect/senses, defined/undefined, stability/change, one/many, same/different. These hierarchic or asymmetric pairs are contrasted by Thesleff with what he calls polar opposites like large/small and light/dark. He also stresses that the hierarchic pairs of Plato's two-level model involve no separation (chorismos), but rather a communion (koinônia).As the words "from his youth to his old age" in the quotation of the previous paragraph indicate, Thesleff is a "unitarian" in his approach to Plato. His Plato is not a philosopher whose positions changed through time as a result of reasoned argument. What many scholars take to be doctrines later given up, e.g., the view that learning is being reminded (anamnêsis), are "thought experiments," which are not followed up, thought experiments made within the context of the unchanging two-level vision.Although Thesleff is a unitarian in the sense I have indicated, he does believe that a kind of order of composition can be constructed for the dialogues. I say "kind of" because Thesleff's chronology involves assumptions of revisions over time, multiple authorship, and even dialogues "written down" by people other than Plato. ArgumentIn 1877, a young mathematician named Joseph Boussinesq presented amémoireto theAcadémiedes sciences which demonstrated that some differential equations may have more than one solution. Boussinesq linked this fact to indeterminism and to a possible solution to the free will versus determinism debate. Boussinesq's main interest was to reconcile his philosophical and religious views with science by showing that matter and motion do not suffice to explain all there is in the world. His argument received mixed criticism that addressed both his (...) philosophical views and the scientific content of his work, pointing to the physical “realisticness” of multiple solutions. While Boussinesq proved to be able to face the philosophical criticism, the scientific objections became a serious problem, thus slowly moving the focus of the debate from the philosophical plane to the scientific one. This change of perspective implied a wide discussion on topics such as instability, the sensitivity to initial conditions, and the conservation of energy. The Boussinesq debate is an example of a philosophically motivated debate that transforms into a scientific one, an example of the influence of philosophy on the development of science. (shrink)

The tremendous recent growth of the women's movement as a political force has been accompanied by an event of equal import to the academic world--the development of the discipline of women's studies. Colleges across the nation are establishing programs in this area. Women's Studies is a classroom anthology designed for use in these newly-introduced courses.

A popular approach to defining fictive utterance says that, necessarily, it is intended to produce imagining. I shall argue that this is not falsified by the fact that some fictive utterances are intended to be believed, or are non-accidentally true. That this is so becomes apparent given a proper understanding of the relation of what one imagines to one's belief set. In light of this understanding, I shall then argue that being intended to produce imagining is sufficient for fictive utterance (...) as well. (shrink)

A common view in both philosophy and the vision sciences is that, in human vision, wavelength information is primarily ‘for’ colouring: for seeing surfaces and various media as having colours. In this article we examine this assumption of ‘colour-for-colouring’. To motivate the need for an alternative theory, we begin with three major puzzles from neurophysiology, puzzles that are not explained by the standard theory. We then ask about the role of wavelength information in vision writ large. How might wavelength information (...) be used by any monochromat or dichromat and, finally, by a trichromatic primate with object vision? We suggest that there is no single ‘advantage’ to trichromaticity but a multiplicity, only one of which is the ability to see surfaces and so on as having categorical colours. Instead, the human trichromatic retina exemplifies a scheme for a general encoding of wavelength information given the constraints imposed by high spatial resolution object vision. Chromatic vision, like its partner, luminance vision, is primarily for seeing. In this impressive study of early Modern Philosophy, Jacqueline Broad analyzes the influence that Cartesianism has had in the development of feminist thought. Her work covers the early modern philosophy of Elisabeth of Bohemia, Margaret Cavendish, (...) Ann Conway, Mary Astell, Damaris Cudworth Masham and Catherine Trotter Cockburn. She points out the paradoxical relationship between current feminist philosophy and the writings of early Modern women. Broad concentrates on the metaphysical issues of mind-body dualism, thinking matter, and the role of reason in knowledge.Recent feminists have argued that even though Cartesianism appears to emphasize an egalitarian concept of reason, it entails a male bias which excludes women from philosophy. Broad covers the work of Genevieve Lloyd, Hilda Smith, Margaret Atherton and other feminists. Her goal is to show that the common Cartesian interpretation of early women's writings obscures the anti-Cartesian and anti-dualist aspects of their thought. Like Lloyd, she argues that historically women were associated with a lesser form of reason following the rise of Cartesianism.The conflict between reason and femininity is noted in the complexity of early Modern thought. Broad argues that even though Elisabeth is remembered as a critic of Descartes, many of her suggestions are not as anti-dualist as some scholars believe. Broad highlights the critical content of Elisabeth's letters to Descartes and discusses her criticisms of dualism and her Cartesian method of discovering truth and certainty. On the basis of her letters she contends that Elisabeth can be regarded as a precursor to feminist philosophers who give an equal role to the body and emotions in their metaphysical and ethical writings.Like Elisabeth, Margaret Cavendish rejects Cartesian dualism. The common thread that runs through early Modern feminist philosophy is the argument that interaction between two unlike substances is inconceivable. Broad argues that like Cavendish, Anne Conway ascribes spiritual characteristics to the body and material properties to the soul. According to Broad, their ontological views amount to a rejection of the stereotypes of femininity.Broad argues that Mary Astell's metaphysical views diverge from the modern Cartesians of her time. Although she is indebted to Descartes, Broad contends that she supports a metaphysical system which avoids some of the gender biases identifiable in Cartesianism. Astell, for example, does not find a life based on reason as a rival to a life concerned with the body; her emphasis on rationality is simply a reaction to the stereotype of women as irrational material beings.Damaris Masham is generally considered a philosophical rival of Astell, but Broad argues that Masham's arguments are focused on the same presuppositions as Astell's. She argues that both philosophers champion women's education, criticize the occasionalism of Norris and believe in interaction between the corporeal and incorporeal worlds. Broad emphasizes the common theological outlook inspired by Cambridge Platonism. Contrary to the interpretation of Ruth Perry, she finds that there is sufficient evidence that Masham was positively inspired by the second part of Astell's Serious Proposal.Broad concludes with an analysis of Catherine Cockburns' metaphysics and moral philosophy. According to Cockburn, women's ignorance is simply the result of being discouraged from rational pursuits. This empirical study examines corporate responses to activist shareholder groups filing social-policy shareholder resolutions. Using resource dependency theory as our conceptual framing, we identify some of the drivers of corporate responses to shareholder activists. This study departs from previous studies by including a fourth possible corporate response, engaging in dialogue. Dialogue, an alternative to shareholder resolutions filed by activists, is a process in which corporations and activist shareholder groups mutually agree to engage in ongoing negotiations to deal with social issues. Based on a unique dataset of resolutions filed by member organizations of the Interfaith Center on Corporate Responsibility from 2002 to 2005 and the outcomes of these resolutions, our analysis finds that corporate managers are more likely to engage in dialogue with shareholder activists when the firm is larger, is more responsive to stakeholders, the CEO is the board chair, and the firm has a relatively lower percentage of institutional investors. Support for the prototype theory of categorization was found in a study of the structure of social categories. Though occupational terms such as DOCTOR are socially defined, they do not have the classical structure their clear definitional origins would predict. Conceptions of social categories are richer and more complex than those of physical object categories and subjects agree upon them. Comparison of various instructions for eliciting attributes of categories showed that whether subjects are asked to define a term, give characteristics, (...) or describe ways they recognize members of categories, the attributes they list contribute to a prototype structure. These data provide evidence against the view that prototype structure is relevant only to an identification procedure and not to the core of concepts, as has been suggested. (shrink)

This article examines the complaint that arbitrary algorithmic decisions wrong those whom they affect. It makes three contributions. First, it provides an analysis of what arbitrariness means in this context. Second, it argues that arbitrariness is not of moral concern except when special circumstances apply. However, when the same algorithm or different algorithms based on the same data are used in multiple contexts, a person may be arbitrarily excluded from a broad range of opportunities. The third contribution is to explain (...) why this systemic exclusion is of moral concern and to offer a solution to address it. (shrink)
